Navigating labor laws in California can be complex, particularly for home care agencies. Understanding these laws is essential for maintaining compliance and avoiding penalties:

 

  • Wage and Hour Laws: California has strict wage and hour laws, including minimum wage, overtime, and meal/rest break requirements. Make sure caregivers are compensated accordingly.

  • Overtime Rules: In California, caregivers working more than eight hours in a day or 40 hours in a week must be paid overtime. Understanding these rules is crucial for scheduling.

  • Paid Sick Leave Requirements: Employers must provide paid sick leave to caregivers, accumulating at least one hour for every 30 hours worked.

  • Meal and Rest Breaks Exception: While most employees in California are entitled to meal and rest breaks, personal attendants are exempt from these requirements.
